Acceptance of Terms

By downloading, installing, or using Pulse ("the Service"), you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Pulse Analytics.

If you do not agree with any part of these terms, you must not access or use the Service.

Description of Service

Pulse is an iOS health analytics application that reads data from Apple HealthKit and provides AI-powered insights and analysis of your personal health metrics.

The Service connects to third-party infrastructure providers and AI service providers to deliver its core functionality, including data storage, authentication, and AI-powered analysis.

Account & Eligibility

To use Pulse, you must meet the following requirements:

• You must be at least 16 years of age. By using the Service, you represent and warrant that you meet this age requirement.
• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
• Only one account is permitted per person. Creating duplicate accounts is prohibited.
• You must provide accurate and truthful information when setting up your account and profile.

Health Data Disclaimer

• AI-generated insights are observations derived from your data. They are not diagnoses and should not be treated as such.
• Always consult a licensed healthcare professional before making any decisions about your health, medication, or treatment based on information from Pulse.
• Pulse does not claim medical-grade accuracy for any metric, trend, or insight it surfaces.
• Individual results may vary. Health metrics can fluctuate for many reasons unrelated to underlying conditions.

Acceptable Use

You agree to use Pulse only for lawful purposes and in a manner consistent with these Terms. The following are expressly prohibited:

• Attempting to access, query, or interfere with other users' data or accounts.
• Reverse-engineering, decompiling, or disassembling the app or any part of the API.
• Deliberately abusing rate limits, flooding the Service with requests, or attempting denial-of-service attacks.
• Using the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempting prompt injection, jailbreaking, or any manipulation of AI model responses to circumvent intended behavior.

Violation of these restrictions may result in immediate suspension or termination of your account without notice.

AI-Generated Content

Pulse uses third-party AI models to generate health insights and respond to your queries. By using the AI chat feature, you acknowledge:

• AI responses are generated by third-party AI model providers and are subject to their respective usage policies. Pulse does not control the underlying model infrastructure.
• AI responses may contain inaccuracies, incomplete information, or errors. No AI-generated response should be considered definitive.
• Pulse is not responsible for the quality, accuracy, or completeness of AI-generated output.
• You should not rely solely on AI insights for any health-related decision. Always seek independent professional advice where appropriate.

Subscription & Pricing

Pulse offers the following service tiers:

• Free tier: 3 AI conversations per calendar month, core health metric dashboard.
• Pro tier: $4.99/month — 50 AI conversations per day, trend analysis, and priority insights.

Prices are subject to change. We will provide reasonable notice of any pricing changes before they take effect. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

All subscriptions are managed through the Apple App Store and are subject to Apple's terms and billing policies. Refunds are handled in accordance with Apple's refund policy.

Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

• You retain full ownership of your health data. We do not claim any intellectual property rights over data you provide or that is synced from Apple Health.
• We process your data solely to provide and improve the Service. We do not sell your personal or health data to third parties.
• You may delete your account and all associated data at any time from within the Pulse app. Upon deletion, your data will be removed from our systems in accordance with our Privacy Policy.

Intellectual Property

The Pulse application, its design, branding, original content, features, and functionality are owned by Pulse Analytics and are protected by applicable intellectual property laws.

• You may not copy, modify, distribute, sell, or sublicense any part of the Service without express written permission from Pulse Analytics.
• The Pulse name, logo, and associated marks are trademarks of Pulse Analytics. You may not use these marks without prior written consent.

Feedback, suggestions, or ideas you submit regarding the Service may be used by us without any obligation or compensation to you.

Service Availability

We aim to provide a reliable, high-quality service, but we cannot guarantee uninterrupted or error-free operation.

• We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service, with or without notice, though we will make reasonable efforts to communicate material changes in advance.
• Pulse depends on third-party infrastructure and AI service providers. Outages or degradation in those services may affect the availability or performance of Pulse, and we are not liable for such interruptions.
• Scheduled maintenance may result in temporary unavailability. We will endeavour to perform maintenance during low-usage periods.

Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Pulse Analytics is not liable for any health decisions, outcomes, or consequences arising from your use of or reliance on AI-generated insights or any other content within the Service.
• Our total aggregate liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the total subscription fees you paid to us in the twelve (12) months prior to the event giving rise to the claim.
• We are not responsible for data loss caused by factors beyond our reasonable control, including but not limited to third-party infrastructure failures, force majeure events, or your own actions.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the European Union and applicable member state legislation.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the competent courts of the relevant EU member state.

Changes to Terms

We may update these Terms of Service from time to time to reflect changes to the Service, legal requirements, or our business practices.

When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you via the app or email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. If you do not agree to an updated version of the Terms, you must stop using the Service.
